  • Nude Pics of Desperate Housewife

    Nude pictures of Marcia Cross from “Desperate Housewives” have been found.

    A company that was hired to remove trash from her house found nude pics of her in the trash.  Apparently there were over 200 of them.  She is trying to stop the pictures from being printed.  The company that collects her trash has said that she has no right to them because she had thrown them away.  Here is the link:  http://sfgate.com/cgi-bin/blogs/sfgate/detail?blogid=7&entry_id=10383

  • According to copyright laws, all photographs are the property of the photographer not the person in the picutres, so they were never hers in the first place.

I’ve been sorting through crap to throw out for what seems like forever. I mean I’m constantly doing that, but I never throw out something I haven’t looked at yet. And particularly…I have somewhat revealing photos…and trust…I’m not a celeb…but those photos aren’t going anywhere without my knowledge…and I was just in lingerie not naked. If it’s a mistake…it’s a really embarrassing one because of the obvious nudity, but secondly…for being that stupid…or third…for being that transparent. Peace.

  • First off, if you never want them seen or don’t want them seen later in life DONT take nude photos!!!! Secondly, if you’re going to trash them, shred them first if you’re a celeb. IDIOTS! My guess is that it’s publicity. Uh… unless you’re a complete moron! LOL

  • I’d say once she hired someone to remove the trash, they became the responsibility, & property of the company that was hired to take them away……  At any rate, whom ever they belong to leagally now….. how STUPID can you be to toss out something like THAT, & Hire people to take it away?!?!?!!!  C’mon, you burn them, you shred them, or otherwise get rid of them YOURSELF…… You Do NOT Hire someone to Do It!!!  I’d say it’s a publicity stunt, & much ado about nothing……….. 

  • Photographs are legally property of the photographer, not the subject. Trash is usually considered fair game for anybody. This is why there are certain things that should be shredded or put in the burn pile.

    I don’t know the law, but if I had to guess I’d say that since they were in the trash, she has no legal right to them any longer, unless it was trash INSIDE her house.. I think that should be different. But regardless, she is a completely utter idiot for not shredding or burning them.

  • If you don’t want your nude pics getting out, it’s best to destroy them. However, the “in the trash” defense seems flimsy. That gives people the right to do all kinds of stuff (like stealing a person’s identity) based on what they find in the trash.

  • No, once she put them in the trash she lost ownership and they are no longer her property.  If you put your trash on a public street and not in your yard people can dig through it and get out what they want legally.  Unfortunately, she has lost ownership of the pictures.  Now…I have heard of other celebrity cases though were the celebrity was able to sue and keep pictures like this from being printed, but I don’t know if she will get so lucky.  Just goes to show, if you don’t want someone seeing you naked, don’t take naked photos…

  • The pictures arent LEGALLY hers because she DID throw them away but i understand WHY she would want to stop them from being printed.

  • The actions of the garbage company owner are sleazy beyond belief. Before examining the question of ownership, what of that of bonding? Many companies or people that have the opportunity to interfere with the well-being of others have to sign agreements or post bonds in order to be in business; is thi scompany now in violation of such an agreement? Also, if “the company was hired,” rather than being a public garbage disposal service, then Ms Cross did not “throw them away,” but commmissioned said company as her agents – presumably she also paid them - to remove and dispose of the gabage. Until ultimate destruction or disposal onto a dump site it remains her property, and the commission remains unfinished. All this is before the question of copywright, which does not cease because a specimen is abandoned.

    This one really makes me want to puke. It makes Xanga’s wildnesses look innocent.

  • If it’s on the curb, it’s fair game. Police don’t need warrants to search through someone’s trash if it’s at the curb so the same concept applies here. If they went up to her house and through the trash can, that’s different. I’m not sure of exactly where all this is said, but I know it’s been brought up in court multiple times and pretty much always with the same outcome. In fact, when the trash is on the curb, it may even be considered the property of the city or company that is hauling the trash, but I’m just guessing on that. (FYI, I work in the SW industry)

  • Legally, no. Just as trash is considered discarded property when you put the bin out to the side of the road, she discarded the pictures, and no warrant would be necessary to seize them. I don’t know what kind of contract such companies would have, so she might be able to sue them for breaking the contract if there were non-disclosure agreements. I think that would be unlikely, because such agreements usually are only found in sensitive data removal businesses, like for doctors and lawyers. If it was such a company, they would lose alot if the word got out that they wouldn’t necessarily keep the garbage secure.

  • As the creator of the images she is the owner of them as intellectual property. I don’t think she should have any say in their return to her or destruction, but she does have a right to control their reproduction. Basic copyright law.

  • according to the new terrorist freedom act or whatever it was called; the president set out on; any trash can be looked at incase your a terrorist. therein all trash is public and federal property. in same states this is the law. thats so you will recycle. you dont have an option; all trash is gone through and plastics go in one area; paper another and metal in another; food left overs in another. thats why SC can force people to reuse and reduce and all that other happy mother earth sh^%&*@#@. yes the state here in SC goes through your trash nd divids it up so it can be reused. its a little hard to have a dump down by the ocean. plus alot of the state is swamp so dumps are not that big of an option. its clean and all that other crap too. the green party really controls the government down here. thats why lesbians are more accepted here is because the green party controls everything; even the trash. the people who divide up your trash make like 23 bucks an hour and they have thousands upon thousands of people who do that job.

    if those pics was found here they would have been divided up. the plastic pictures in one area; the paper print outs in another, and the fiberglass pics from the joycams would be put in one of the other ones. could someone pocket those pics and sell them??? yes but they make goood money and get good coverage so it hardly happens. working in trash is big big business here.

  • There was actually a court case like this once, called California vs. Greenwood. Greenwood was suspected of drug trafficking, the police searched his trash and found suspicious items, they used it to get a warrant, and they searched Greenwood’s house and got him arrested when they found hashish and marijuana and whatever else. Greenwood brought the case to the courts and they determined that anyone can go through your trash and that he was still guilty.

  • Publicity stunt?  No person in their right mind would purposely throw out nude pictures.  Shredding isn’t even good enough – FIRE.  My guess is that it is a stunt since she is pregant and might not be up to all the shots they want of her right now.  Just some thoughts on the subject.  I should give her the benefit of a doubt, but I have seen too many “stars” use this type of thing to their advantage.  Didn’t anyone see CSI, N.Y. show last week?  It had a storyline similar to this only on “anger management”.

  • From a legal standpoint, whether or not the pictures are public property depends on local statutory law.  It’s different everywhere.  However, because the garbage pickup company has a pre-existing duty to collect the garbage, from a legal standpoint it is doubtful that they can actually now claim ownership of the photos.  If they do, they could besued for damages for everything from defamation of character to blackmail…and they would lose.

    It’s in their best interest to destroy those pictures.

  • as far as i know, her image is her property, not the picture, so any pic without her permission, no matter where they come frome are not allowed to be published.  But I do thinkas well, that they take some defensive arguments to have some benefits ;)

  • Well, if she hadn’t wanted anybody to find the pics, she shouldn’t have thrown them away in the first place. Maybe she should have shredded them in a paper shredder over and over and over again until they were tiny little pieces first and then threw them away, lol. But technically, it is her own garbage, so that company has no right to take them, but whatever. Besides, why would someone take over 200 nude pictures of themselves, print them, and then throw them away? Now that doesn’t make much sense, does it? I mean, I could see if she was planning on doing something with them, but seriously.
