Oral Sex and Age of Consent
Genarlow Wilson is in prison for having oral sex with a 15-year-old girl.
He was 17-years-old when he had oral sex with the girl. Under Georgia’s law at the time, he was a child molester even though the oral sex was consensual. He was sentenced to 10 years in prison. He has served 2 years in prison since his conviction.
Today a federal judge reduced his sentence. The Georgia Attorney General immediately blocked the release of Wilson by appealing the decision of the federal judge. Here is the link: Link
There are so many of these cases out there that cause this issue to come to the nation’s attention. Everyone wants to protect children from child molesters. And yet these are both kids that were underage at the time the oral sex took place.
There needs to be a rule for age difference to set a boundary. Under this rule, a whole lot of us were molested in high school.
What is an acceptable age difference for kids to legally have sex while they are both minors?

if they’re both minors? 2 years man. Thats a 17 year old and a 15 year old. After that its statutory even if its consensual. In Genarlow’s case, i think the guy commited no crime. Sure, what he did might have been wrong, but its not worth 10 years in jail an having to register as a sex offender.

I don’t like that they were doing that any more than the next adult, but (and I work with teens this age on a day to day basis, so I feel pretty dang confident saying this) she could consent or deny, and it was certainly their choice to have alcohol in their systems, something for which every one of those kids should have been equally prosecuted. As for the “rape” charge–when an underage person (or an of age person) consents to drinking alcohol, they better know the risks involved including lowered inhibitions. Unless he drugged her drink, that charge is bogus. Every woman who chooses to drink til she drops could cry rape if that charge were to be allowed. Ridiculous.
Overall, it sounds like Georgia is making this kid the example they need to make out of a REAL pedophile.

the kid has no chance - he’s black and he lives in the firkkin bible belt.. i bet the judge that sentenced him is 70 and white… thats the only reason he was sentenced; they were only 2 years apart and he wasnt even an adult at the time… which raises the question..

three years sounds reasonable…. then again I think sex before marriage is just dumb. Why bother taking that risk of gettings an STD or getting knocked up? (though marriage won’t keep you from either… but I imagine pregnancy is a great easier with a husband to support you)

I don’t think the government should have a say in what 2 consenting people do in their bedroom. I personally don’t feel as though I was in any way molested or taken advantage of or psychologically damaged when I was 16 and had sex with my girlfriend who was also 16. And I think she would say the same. This is just nonesense.
now when it comes to adults with minors there should be a “years apart” rule because it’s so easy for an experienced person to take advantage of someone young and naiive. I think 3 or 4 years at most of an age difference.
Ok, for everyone who is going to talk about abstinence and marriage in this post; stop. I agree with you; I want kids to not have sex until they wedding bands on their fingers, but it’s not gonna happen, so we have to deal with this very realitive issue.
On that note, it’s complicated. I’d say 2 years. Any less seems unfair, anymore seems unreasonable. There certainly is a difference between say, 17 and 11 and 17 and 15. I’d say that 2 years puts the guy and girl both in a place where they are close enough in age to make that kind of decision. (even if it is the wrong one.)

Seems harsh to spend any time in jail over this at all. 15 year olds are having sex, its too bad but real. He was only 17, still really a child too. IT may have been a mistake for both parties, but nothing to spend time in jail over.
Have the parents sit down with the kids, and talk it through. Courts dont seem to be needed.
It seems very very very common in our world for people with 2-3 years age diff to be together.
They were both minors so I don’t think there was any grounds for charging him.
My understanding is that in the state of Kansas, if both are underage then it cannot be charged if the sex was consensual and if one partner is of age then it is legal as long as the difference is three years or less (ie a 19 year old and a 16 year old would be legal but 20 and 16 would not). At least that is what was explained to a class I was in about five years ago in high school by a cop. I think that is a pretty good rule except that there needs to be an age difference for underage also (there may be one, as much as I try to claim that my memory is infallible it is fallible). I believe that 3 years is good.
I think around here it’s like a two year difference, but this case seems completely crazy to me. I don’t think they should be doing that anyhow, especially not a 15 year old,but we all know it happens a lot. If they both agreed to it, I don’t see how they locked him up for ten years. I heard about this on the news and it’s horrible. I guess he videotaped her without consent. He had consent for the sex. I don’t think he should have been imprisoned for any period of time. The real issue with minors is their age (the person they are having relations with our minors too) and consent.

In the UK the age of consent was raised from twelve to thirteen in 1875. In 1876 it was further raised to sixteen, and in addition all homosexual acts became a criminal offense, but only between males. In 1967 homosexuality was de-criminalised, the law having ruined the lives of countless males for ninety-one years, for no point whatsoever that I can see. The chicks got away with it scot-free, and this is puzzling, until you consider that women didn’t have the vote until well into the ninteen-hundreds, and it was only about 1864 that a married woman was allowed to own property, so I suppose that it makes sense not to worry about them blowing each other, or whatever, as they were scarcely considered human, like performing monkeys or something.
There is a legal principle stating that laws which are stupid or cannot be enforced should not be made, as they bring the law into disrepute, and the British Government is now debating the lowering of the age of consent from sixteen to fourteen, as no one is taking any notice.
The point of my long ramble is that half the stuff solemnly introduced as law is really whatever confused mess is seen as good at the time, and as with many things, the point isn’t to help anyone; it’s to tell others what to do.

in alabama the age of sexual consent is 16, as long as your partner is not more than 3 years older than you. (i think this is called a “romeo and juliette law.”)
once you turn 19, which is the age of majority here you can sleep with anybody regardless of the age gap.

I believe that in Texas the age difference has to be 3 yrs or more.
I agree with most of everyone else. 10 years in prison sounds unreasonable.
I think the age difference between minors should be about two years. Three is stretching it for me. And to that 19-year-old who is dating a 14-year-old girl, that’s pretty sick. I’m sure you could find someone who is at least a few years closer to your age.

Sadly, I think I’m one of the few that support our current President, arrogant or not.
While being minors I would say no age differences allowed. There is enough jealousy in highschool between the levels (freshman, sophomore, etc) that it would cut down on problems. I also think the age of consent should be bumped from 16 to 17. Might seem a minor difference, but most jurisdictions view 17 as adults than 16 year olds, specifically for runaways.

This should’ve been a case where the judge stepped in and made a ruling under the circumstances. Sure, make him pay for his mistake… but don’t put him on a list with sex offenders!!!!!
I think that older than 14 and younger than 18 is fine as long as it is consensual. The thing to consider is, if she is a freshman and he is a senior (especially since he was a football jock), he’ll be able to talk her into anything–so even though it was consensual, there is the possibility that it was rape or molestation.
17 is the age of consent in many states including my home state of NY.
I think there needs to be a brightline standard for statutory rape but agree that cases like this are difficult.

I would say 2-3 years. Especially at 15 and 17, consensual oral sex should not have gotten this young man 10, or even 2, years in prison. I could see how it might be a different story if he were 18 or older. Now, if were not consensual, that would also be a different story. But for two minors to have consensual sexual relations, I would say maybe slap them with probation or something, but 10 years is ridiculous.
if everyone would just wait until they were married there wouldn’t be this problem. Of course, that will never ever happen. But I think preteens and teens should be taugh abstinence in schools and by parents rather than be handed free condoms in their health classes.
I think within 3 years age difference if they are both minors. My issue with that case is that they were taking a kid who had a lot of promise and achievements and putting him in jail- thus preventing him from getting jobs when he gets out and increasing his chances of committing other criminal acts. I think that Judges and Attorneys have a responsiblity to make sure that the punishment fits the crime. The attorny General in this case clearly had a grudge against him for not accepting a plea bargain that led to his ridiculous and unethical behavior.

you forgot to mention what it was if he had just had sex. i beleive it was a shorter sentence if he had sex with her but the oral was 10. i can’t remember the actual number of years but my brother dad and i were watching the news and we were all shocked it was more years for oral than reg.

If the kids are minors, their parents are still resonsible for them…so, logically, the kids should ask their parents what an acceptable age difference is.

Its tough, sometimes i worry about this being a single minister in his 20′s… its not like im going or seeking out any youth or college people at my church – but im 24 and so late teens, though it seems wrong by some, is not really all that odd. But if I ever was interested in a senior in hs or a freshamn in college – i guess i would have to quit my jon, which sucks but is that would have to happen.

They’ve just successfully made this kid into a hardened criminal who will have to register wherever he goes, will never be respected on paper, and will probably just turn his life to bigger, real crimes because hey, why not! What happened to freedoms? In my state, the age of consent is 16 and/or the two people having sex have to have no more than a 3 year age difference.
When I was 14 I was dating a guy that was 18, and we did have plenty in common and plenty to talk about. We stayed together for nearly a year, only breaking it off because we were young and didn’t want to deal with the stress of him being in college and me being back home.
Anyway, my point is…as long as the person is above a certain age, I don’t know why there has to be a tiny tiny little age gap. 2 years? In high school, seniors are friends with freshmen and they’re 4 years apart. What’s wrong with a friendship becoming a relationship? I’m going to be a senior this year and have plenty of younger friends. Of course we have things in common. Of course we have things to talk about. If kids are starting to do sexual things at 11 and 12 anyway, when they’re 15 and want to sleep with a 17, 18, 19 year old…what does it matter? They’ve had 3 years practice making sexual decisions by then. If nobody is hurt and it’s consensual…I just don’t see why it should be such a huge deal.

It is probably too late to correct this mistake since I’ve noticed it is very prevalent, but there don’t need to be hyphens between 17, years, and old. It can just be written as He was 17 years old. The only time when hyphens can be used are when you are using the phrase as an adjective next to the noun it is modifying (a 15-year-old girl, The 40-Year-Old Virgin). It can also be a noun (The 16-year-old was emo yesterday).

Basically i think high school is a pretty safe guideline. You might get a 14/15 year old freshman who ends up dating an 18 year old senior… I think those kids need some serious parent intervention if they are sexually active at 14 and/or younger… but that’s a PARENTAL thing, not a LEGAL thing. And beyond that… you get into the girl that’s 16 now and dating a senior… and then he turns 19 and maybe she’s only 17… actually we have a case like that here in iowa… and the man is on the sex offender registry and can’t live w/ in X distance of a school or park. He MARRIED Miss 17 a couple of years after she was out of high school, but while they were dating, her parents must’ve pitched a fit and it landed him in the court system… the arguement of course, is if the woman is now his wife, and has been for 15 years… how does that make him a sex offender? AND even better, is the best plan to make him move out of the house he and his wife own and where their children live? Cuz that’s what the city of Des Moines did. I think protecting us and our children from sex offenders is a great plan, but when it comes to consentual sex, there are alot of grey lines that AGE can’t define.

Two years for 12-14s, up to 5 or 6 for anyone over that but still under 18. A 20(ish) year old attracted to a 15(ish) year old is not a child molester, and certainly a 17 year old isn’t. It’s almost insulting to people who actually were molested to say a consensual sexual relationship between a a teen/young adult is molestation. Physically, they’re not even all that different.
No matter what anyone wants to say, by the time you hit 13 or 14 you know what sex is and you are capable of saying yes or no, even if you might wind up regretting it or realising it isn’t always roses and chocolate. Eventual regret and parental disappointment doesn’t mean you weren’t capable of consent. And it’s not like a law is going to stop them. It will just get innocent kids put in jail for no reason.

it is sad that he got put away for something far less that what people are getting away with all the time. i have heard of shorter sentences for for more heinious crimes. but that is why the law was changed. the only thing is. the law changed after he was convicted, and wasnt retroactive, meaning it doesnt apply to crimes already prosecuted. i dont know how all that works, all i know is that the new law, doesnt let him get released. all this because of some teenage horomones. it sounds like to me that someone was just trying to use this case as an example to teenagers to keep their pants on!

Oh, and you totally failed to mention that the… situation… was hardly a committed relationship. It was one of those parties where there is alcohol and drugs and gangbanging. I wasn’t there, but I heard enough about it to know.
It’s two years here and age of consent is 16.
I think it’s disgusting that the kid was only 17 and then thrown into a 10 year sentence for just being a kid, and the 15 year old cannot say she didn’t know what was going on, as she clearly consented for it.
I say that 15 to 18 is a legal right to make one’s own decision. Tough luck if you don’t like it, you might as well be reasonable about it. Banning it will just make kids smarter about not getting caught.

If both are older than 14 or so (but are still both minors), it shouldn’t matter if there’s an age difference.
But then what happens when the 15-year-old’s boyfriend reaches the age of majority? They have to break up for a few years? I don’t know…

i think Turtle_12 is right here. i think they both definitely need a good talking to. especially the girl. i mean, 15? dude, come on… that’s pretty young to be getting so sexual. at least it is in my book. in any case, the courts should not be getting involved if they’re BOTH underage. this is for the parents to discuss with the, er, participants.
Ha ha. I did a paper on this, actually. . and it caused quite the controversy in the classroom. Honestly, in my opinion, a relationship isn’t illegal no matter what age, as long as there’s not sex. So, taken below, someone’s 19 and their girlfriends 14, well, sex isn’t everything, and maybe they should just practice abstinence until their partner and them are both legal. It keeps the “love” of their life out of prison, and maybe it will make stronger bonds. Who knows?! Or, they could always go at it like two rabid monkies, one get the other pregnant, and then. . well, obvious conclusion.
