  • Moral Dilemma

    A man raped a 10-year-old girl.  He attacked her in a park and removed all her clothing and raped her.  He then took her back home and sexually assaulted her.

    But in this case the judge was faced with a “moral dilemma.”  The girl had “regularly wore make-up, strappy tops and jeans.”  She also wore a “frilly bra and thong.”

    The judge said, “It is quite clear she is a very disturbed child and a very needy child and she is a sexually precocious child. She liked to dress provocatively.”

    He also added, “Did she look like she was 10? Certainly not. She looked 16.”

    The judge gave the man a two-year and an 18-month sentence and allowed him to serve them concurrently which means he gets credit for serving both at the same time.  Since he was in jail waiting to be sentenced, he gets credit for that time and will have spent 8-months in jail for raping a 10-year-old girl.  Here is the link:  Link  I found this issue on the site of http://www.xanga.com/mightymarce.

  • How a woman (or in this case, girl) dresses is not part of the law. The law does not read as an if/then statement. It says rape is wrong. Period. Quite frankly, the judge in this case made a disgusting call. If he wanted something to be handled about the way this little girl was dressing, then he needed to refer her and certainly her parents to family court and to Child Protective Services. How dare he do more damage to her psyche by insinuating that, at the age of 10, she was asking for anything like this to happen to her.

    I heard about something that reminded me of this… A guy picked this girl up in a bar (the girl was drinking) and they had CONSENSUAL sex. The guy later got sent to jail for statutory rape because she was 16 and he was over 25. Now, if you find a girl at a bar and she’s drinking, you’re automatically going to assume she’s over 21, right? Sometimes this stuff makes no sense.

  • No, it does NOT matter that she dressed/looked older than 10.  Granted, if she were my 10 year old daughter, there wouldn’t be a chance of getting out of the house dressed in what is considered “strappy tops” by today’s standards.  But regardless of what she was wearing, she’s still 10!  If a 16 year old had been raped, but looked 20, the charges wouldn’t be altered because she appeared to be a legal adult.  Lowering the sentencing because this girl appeared to be older is just wrong!

    The idea that clothing provokes rape is ridiculous. Thousands of individuals visit beaches each year and don’t rape people in bikinis. Rape isn’t about finding someone sexually attractive, it is about forcing sex on someone against their will. Thousands of “attractive” people and thousands of “unattractive” people are raped each year. When rapists are asked what clothing they look for in a victim, most actually say they look for baggy clothes that are easy to grab, cut and/or rip off.

  • I think that its really bad to actually rape somebody, age doesn’t matter, but if I were to put myself in the shoes of her parents or guardian, where were they when she was on the street?   • Having not read the transcripts from the court,  its impossible to decide or judge for ourselves the situation as it occurred. 

    However, 10 or 16,  it really doesn’t matter..  he is a predator,  trying to find anyone whom he can control for long enough to meet his depraved objective.

    To answer your question:  16 is still a minor!  I don’t get the difference.  Yeah if she was 16 and lied and said she was 19 in order to get consentual sex that is different.  But it was rape of a minor whether she was 10 or 16 or wearing a thong or nun frock.  What the *$@% is wrong with that judge?  He feels raping a child who is “very disturbed” is less of a crime than raping a child who is niave and innocent?

    Why should the way she looks be a factor in the sentence - the FACT is, she IS 10, and she was RAPED.  And I don’t care how much make-up she was wearing, or what kind of bra she was stuffing, how do you not tell the difference between 10 and 16???  Emotionally, behaviorally, and PHYSICALLY it would be OBVIOUS to tell the difference, even if she was emotionally disturbed.  Oh my gosh, I cannot express my disgust enough over this.  Both the judge and the rapist should die, but the judge in a much more painful and humiliating way I think, because he is prolonging the pain and humiliation of this girl and abusing the system rather than seeking to help her which is his JOB.

  • This is the craziest & saddest story I may have ever read.  I’ve seen other comments where people are blaming her parents for letting her dress provocatively.  I went to the link provided & read the article which stated that she’s been a ward of the state since she was 4 years old.  Should the state not be heald responsible here as well?  Why was a 10 year old allowed out at any time of day or night without adult supervision?  How is she coming by these age-inappropriate clothes through the state?  The whole thing does not make sense, but do they not have madatory sentences for certain charges in Britian as they do here?
