  • Man Falsely Convicted of Rape

    A man was falsely accused of rape and he spent 24 years in prison.

    A DNA test showed someone else committed the rape and he was given $6 million.

    His wife divorced him after he went to prison but did stay with him for ten years.

    His ex wife is suing saying she deserves part of the money. Here is the link: Link

  • No, she doesn’t. I assume she divorced him cause she thought he was guilty when he wasn’t. Why should she get any money from him?!? Plus they are already divorced so whatever he has now belongs to him and nothing should go to her. What she should get is a slap in the face!

  • No. She divorced him. She didn’t stay with him and see it through that he didn’t do it. What she needs is to get the hell out of here. 

  • He was falsely accused of rape ? Which dude did he say that raped him then ? Minju for $6-million dollars I guess you can afford to get a little pampering to make up for it, but still whatta turned decision by the courts !

    And NO, she shouldn’t get a dime if she divorced him. If she visited him in prison and brought band-aids and gentle toilet paper for sensitive bottoms and told him and said, I’m so sorry you got raped and junk I wish I was there to stop it, than yah, she might be entitled.


  • She deserves the compensation the court awarded her for the lost wages during the time they were married and he was in prison. Their child deserves something, as does the child from his previous marriage, for child support that could not be paid while he was incarcerated. But she doesn’t deserve a windfall. She remarried and moved on. He will struggle to find employment, regardless of his innocence, because he spent 24 years in prison. That compensation package will most likely have to see him through the rest of his life.

  • No, she didn’t serve all of that time in jail and her humiliation would be nothing in comparison to his. She just sounds greedy, and she didn’t stick it out in the long run.

  • I find it interesting that people would leave a marriage due to a lack of sex (see Dan’s earlier post) but have more of an issue with a woman leaving her husband for being in jail AFTER he was accused of rape. 

    Read the article folks!!  Here are the important parts:

    “He was a victim of a wrongful justice system, and his family was also,” Tucker(ex wife) said.

    “And, he (Phillips, falsely accused) argued, because he was ineligible for compensation until well after the divorce, the money he received should not be subject to division under state community property laws.”

    “Tucker said she could not calculate how much money she and her family had spent on lawyers, travel and necessities from the
    prison commissary during the decade she was married to Phillips.  “To me, marriage was for life, and I was going to be
    with him forever, and we were going to get through this — or so I thought,” she said.  The divorce, she said, had been requested by Phillips, who grew distant and wanted her to move on.”

    My gut feeling is that she’s being a greedy wench but this is actually an interesting situation to ponder.  Where is @ordinarybutloud ?

  • What a money-grubbing bitch! Hell no. $6 million is a shitty consolation for 24 years of your life which can never be replaced. I’m glad the poor guy at least got something, though.

  • She deserves some kind of compensation from the state, but not taken out of his portion. Falsely imprisoning her husband ruined her life too, though of course not as much as his. She stayed married to the man for the first ten years of his sentence, and continuously protested his innocence! That kind of marriage would likely have lasted their entire lives had he not been falsely convicted. The only party guilty in this mess is the state. 

  • She either needs part of his portion or a separate amount by the state.

    As cranky as everyone is, she was essentially forced into single motherhood raising his son with all the financial and emotional sacrifices that comes with doing it alone.  Besides, the divorce was at his request after she had spent a good deal of time trying to be helpful to him while he was in prison. 

  • @light_blue_fables – You make a good point – her life was screwed up too. But I don’t think she should be entitled to some of his compensation – she should be eligible for compensation from the state.

  • This is the kind of case that spawned the terms like, “It’s enough to piss of the Pope,” and “Doesn’t that just take the cake?!”

  • First, I don’t know if she divorced him because she didn’t believe in his innocence.  She defended him on the witness stand.  But the system ruined his life, her life, and every life touched by the horrible injustice.  The system should pay big time, and I doubt they could pay enough for me to think it is entirely just.  So yes, she should get money.

  • No. In this era, women have no reason to take a portion of everything a man owns, no matter who asks for the divorce. It’s an obsolete system that needs to be overhauled in light of modern gender roles.

    Just because they used to be married, and just because he’s now got some money doesn’t mean she’s entitled to a penny of it – she wasn’t the one locked up with her freedom and integrity lost.

  • She was a traitor, she left him in his hour of need.  She should get NOTHING.

  • If it is true that she divorced him because HE wanted a divorce and to move on, after being together for 10 years of this and her life was clearly also messed up, yes, she deserves SOME compensation… but not from him. It should be from the state, he didn’t fuck her life on purpose….

  • who’s paying the 6 million. US?!??!?!?!? You know, this reminds me of the story I heard on “This American Life” where the guy was falsely accused, then once he was released, he brutally raped and killed a girl. Once you go into prison, you are changed and instead of the people paying 6 million to the guy we should be paying for rehabilitation. Also, the wife deserves part of the 6 million, she was affected by her husband going to jail.

  • Not sure about ‘deserving’ it, but I’d be tempted to give her something for sticking by me for the 10 years.  At least until she took me to court.  Then I’d be far less tempted.  

  • Two people I knew in high school dated, and the girlfriend accused her boyfriend of raping her. She never went to the police to file a report, she just spread rumors around school. Years later, she apologized to her ex for the accusation and bought him a sandwich. He ate the sandwich, but still holds a grudge. I’m not really sure how that answers the question or if there is even anything to learn from all this, but if DMV were here, he’d say sandwiches are, like, really fucking delicious.
